Why SKULL bill ? As a high level manager I have learned after years of experience that you need to use good sense of humor, satirize when confronted with insanities and very stressful situations.
I appreciate your effort to make us smile and relieve stress but when you repeateldly

In the SR, was there any timeframe such as wait for 30/60/90 days?
I sent an email to my congressman immigration staffer on Monday, about my spouse's case ( EB2 I, Dec 2005). Got a snail mail yesterday that they did not get a response and are still waitng for a response. Today, i called their office and they said they got a response and the case is assigned to on officer and wait till September 10th. My wife had spoken to 2 tier support on Auguts 5th who said your case is assigned to an officer and you are pre adjucated. We also got a response to our SR created on August 5th, which says case under review. I guess the wait goes on.

Dates move ahead means almost all people before 8 Jan 2005 will get their GC in Sep 2009.
If that comes not true then DOS has given Spill over visas to Eb2 india on day 1 of new quarter and will do same for every quarter. If this is the case then date will move forward only in Jan 2010 bulletin.
and if they moved date forward because there are only few hundreds case between Jan 8 and Jan 22 2005 then we will see very big movement in Aug - Sep 2009. There are very few Labor since Nov 2008. So Eb2 ROW will not utilize even 10k visas in next year thus Eb2 row will donate 20k + visas to Eb2 india and Eb1 do same ... if Eb4 and Eb5 doesnot get renewal before Sep 30th then expect 5k more visas total almost 55k Spill over to Eb2 india and China which will make Eb2 C by Sep 2010..

A lot of people can give you advice but I think it really comes down to making peace with yourself.
I have been thru the pain of being stuck in LC for over 4 years and I can completely sympathize with you. I know it can be really frustrating. I have been thru swings of optimisim and pessimism in those 4 years. Ultimately this is what I have realized, there is always a price to be paid in life if you want to achieve anything in life. It is upto each one of us to decide if GC is worth the various years of being stuck in same job, wife being stuck on H4 is the right price for GC or am I paying too much. For me personally, I think I am paying a big price but I am like a businessman who has invested so much money and time in his enterprise that he's afraid to drop the venture and start another business. Actually a lot of us fall in this category.
So look at it this way. Write down the price you are paying. Figure out if you still want to put your effort (and how much) in trying to get a GC. If you think its a venture that's not worth the outcome, there's your answer! If you think its worth the outcome but you are afraid you still may not get a GC, work on backup plan i.e. evaluate and apply for immigration to other western countries or evaluate and work on a plan to go back to your home country. Knowing the price and having alternate plans will give you peace of minds. More than anything else don't forget to have fun. A lot of times we get caught up in worrying about what might/might not happen in future and don't enjoy the present! Go out with your wife and have a fancy dinner every now and then ... do something spontaneous... Watch movies, listen to music, go bowling with friends ... whatever takes your mind off the routine!
I see a lot of guys telling everyone who is frustrated saying: Let your wife get her own H1, why don't you buy a house on H1, why don't you have kids? Well, its good to offer suggestions but don't get condescending. Not everyone is fortunate enough to have a stable job that they can buy a house. Not everyone's wife is in IT and can get a desi co. to sponsor H1. Not everyone is at peace mentally enough that they can plan children.
Well, I am TOO depressed about the BEC performance. I know too many people are in same situation but I find myself "helpless" and at least i want to SCREAM......:mad:

If you or any one else is planning to move forward with some plans for helping EB3 folks, expect some serious opposition to your efforts. Many EB3 folks themselves do not see any need for EB3 only actions.
A bunch of us talked to a lawyer regarding the INA and the initial reaction was not very encouraging. The lawyer was suggesting us to convert to EB2.
Lawyers would always suggest you to port to EB2, even in case EB3 I is going to be current tomorrow. Simple truth, they need money! So don't listen to lawyers on THIS!

The problem will come, if you have an RFE for employment. If you get a letter from client, they will say that the company has employed, say for example Mr John as a Programmer Analyst for a period of 1 year. This will open up one major issue, that is you do not work for a company. The H1 and 485 is an application that is sponsored by a company, there is no clause for self sponsor. So when they see u are self sponsored, they could reject your 485.

I just read first page of this thread and would advice that don't follow most of reply because they are lawyers or they have not gone through the experience you are going through. $4000 may not be big amount compared to hassle of law suite , piece of mind or the amount of increase you may have received by switching employer. I know a close person who had gone through exactly same situation in NJ and had to pay 12,000 to settle the case. I have seen bunch of people in same situation and my friend always adviced them to stay away from law suite. If your current employer is not big then there are greater chances that it will turn away from you in case of law suite.
If you are not working with same client that you were working when you were in company A then non-compete may not hold against you.
Also can you get in writing from you current employer that they will support you in case of law suite?

He did not leave within couple of months for crying out loud. Some of the desi employers are so greedy and unethical that even after you slog with them for years, they still want to hold on to something just to prove they are employer/boss. This is a lesson for people wanting to help their employers business. I would tell them that it is none of their business to help their employer�s business.

Thank you Aman & all the other immigration voice members who have spent so much time, energy and resources in advocating on behalf of all of us. I have been working in the non-profit sector for the past 8 years and from experience suggest that in order for this movement/advocacy campaign to sustain it is important for us to have a system in place where core campaign members are reimbursed for their past and recurring expenses. We have contributed to IV previously and would like to pledge $200 towards Aman's expenses.
