Finally we have decided to go back to India for good. I filed my EB3 in May 2003. Its going to be another 4 years to get the green card. When I went to India for vacation last December, we liked it over there & the economy is booming. There are all sorts of discussion regarding the Economic Gap/Politics/Corruption/Cleanliness. But we like it over there. Finally I will have an option to do something interesting. In US I was very much dependent on my monthly pay check and afraid to take even the slightest risk. I am also scared to use the AC21(Hey, thats the way I am). I am working with the same company for last 10 years, kinda stagnant in the last 4 years. In India, there are lots of choices, either to work for a sw company or start some business on my own. I think I will take the business route.
May be I can go there, earn well, send my son to US for college, do green card through him & come retire in US!!!

Great relief, moved one step up in the line!!! Just kidding. all the best man. I believe India has growth potential for next 15-20 years. India need to mix few ingredients to its growth like law & order, infrastructure, accountability, reduce bribery, traffic education etc..

Hi, all:
I have a few questions regarding changing job, if anyone knows it , please reply to me. My current situation is:
(1). I-485 was sumitted on 07/2007 and it is still pending. EB3 category.
(2). EAD card valid until 10/2012.
(3). H1-B visa valid until 03/2012 through my current employer.
I find another job which similar to what I-140 describes. But this new employer is a job agency and unwilling to tranfer my H1-B visa. It wants me to work on my EAD card on 1099 form.
So, my questions are:
(1). Will it be problem if I work as independent contractor on 1099 form not W2 form?
(2). Is there any problem to new my EAD card since I lost my H1-B visa?
(3). Do I need to inform INS about this job changing? If so, what docuements I need to submit?
(4). What if my current employer revoke my I - 140, does that mean my GC will be denied? what should I do if I want to keep legal?

I got finger print notice on 6-16-07.
I never got receipt notice and I could not read the number in back of my check image. My attorney even did not get any receipt notice either:confused:
The finger print is scheduled for July 7th. I sent all app. to NCS on the June first and they transferred to TCS. PD of Sep 2003 and I-140 was approved 2005. I also apply for travel doc. and work permit but no receipt so far.:rolleyes:

My labour and I-140 is approved last year and I am working with current employer from last 1 and half years. Employer is making good money trough me....

Its all about how you negotiate. You may have some leeway in your negotiations if you have enough years left on your H1B. If all other peaceful negotiations fail let them know - without loosing your temper - that filing I 485 is the most important thing for you at this point and if it does not get done before the PDs retrogress again you will look out for other job using H1B transfer. All they worry about is the billing money they get out of you and they are worried once you file I-485 they will loose it in 6 months due to AC21. If you make them see that they will loose it other way too they may cut some deal with you.

Well, it goes beyond that. This is a "complicated story with no sub titles".
IV website is a board where people of all kinds visit and there is no control over stuff. Just go to any blog site - we see 100 rants and crazy comments as against a few wise talk.
I guess we have to live with it and keep pushing people. Sometimes loud and sometimes gently.
My friend, it is to "push the people" that I am saying all this. How best can we push? Through word of mouth, or thru full campaign?
Another idea: How about restructuring the forums?
In the home page, we promote only those discussions that are important to all, like advocacy.
In next tab, we take on the discussions that are based on individual problems
And all else, can go to the third tab
Also on home page, the following items (just some examples of general interest matter):
- Advocacy day. Donations received vs required.
- Big red button: Donate
- Some links to recent news items on immigration

You can quit after six months and then if taken to a court of law, you can tell the court that the employer refused to give you employment letter and under duress, you were forced to sign the letter. Your other option was to pack bags and leave the country if the employer did not give you the letter. And you can argue that the law lets you change employer after 180 days and hence you are not breaking the law. You can also argue that if the employer had not acted in bad faith by refusing to give you employment letter, you would have continued to work for the employer.
Ofcourse, you will need a very good lawyer if you want to fight the case on moral grounds (because it may be more expensive to fight the case than just pay the amount agreed to in the letter).
